Is it possible to fire an employee during the war?
The Ukrainian economy is now going through, perhaps, the worst of its times. Due to the military aggression of Russia, many were left without the houseroom and work.
Enterprises in many regions were forced to close or reduce their production due to the inability to fully operate under the blockade or occupation. Some companies also decide to lay off during martial law.
Martial law was introduced throughout our country. How labor legislation works under such conditions, whether employers can fire workers, and on what grounds, tells the job search site Login Casino Work.
Today, employers are faced with the task of using all possible mechanisms to keep jobs for employees. Dismissal of people at the initiative of business owners can be classified as a gross violation of the law.
The State Labor Service of Ukraine provided several clarifications regarding the dismissal of employees under martial law.
Often the question is not even whether they can be fired during martial law, but rather, whether they can be asked to write a letter of resignation of their own free will.
So far, there is no ban on the dismissal of workers of their own free will. If a person left the place of permanent residence due to hostilities, then such an employee cannot be fired for absenteeism. But there is no reason to keep a job and an average wage for him.
Can they be fired from work during martial law, and even unilaterally at the initiative of the employer, if the reason for dismissal is staff reduction?
In fact, the State Labor Committee advises, if possible, to refrain from dismissing workers before demobilization is announced. At the same time, the law does not provide for a ban on dismissal due to staff reductions even under such conditions, and the question of whether it is possible to dismiss during martial law remains rather slippery.
In this difficult time for the country's economy, both employers and ordinary people need support. If business owners have the opportunity to leave people a chance to work and receive wages, it is better to refrain from laying them off.
